Tooele man charged in teen rape

A 24-year-old Tooele man accused of raping a child made his first appearance in 3rd District Court Tuesday.

Benjamin John Magness was arrested on Nov. 12 after a 14-year-old girl was interviewed at the Children’s Justice Center. The teen told investigators that she’d had sex with Magness multiple times at Magness’ apartment, in his vehicle and at her home between December 2007 and March 2008, according to a probable cause statement.

The girl, who now lives out of state, also told investigators that Magness had given her alcohol on several occasions and marijuana once.

Tooele County Deputy Attorney Gary Searle said Magness and the girl were neighbors.

Magness was interviewed by police and admitted to the sexual encounters, according to the probable cause statement.

He was charged with three counts of rape of a child and two counts of sodomy on a child — both first-degree felonies.

Judge Stephen Henriod set bail at $250,000 bondable.

Magness faces up to life in prison on the charges. His next court date is Dec. 9.
